Chapter general provisions

Article in order to standardize digital printing business activities and promote the healthy development of digital printing, these measures are formulated in accordance with the regulations on the administration of publishing, the regulations on the administration of printing industry and relevant laws and regulations

Article 2 These measures are applicable to the business activities of using production-oriented digital printing machines to print publications, packaging and decoration printed materials and other printed materials (hereinafter referred to as digital printing business activities)

the production-oriented digital printing machine mentioned in these Measures refers to the digital printing equipment with high printing speed, stable printing quality, and the ability to realize industrial continuous and batch production

production type digital printing machines should be equipped with digital workflow; High speed digital multi-function machine equipment does not belong to production type digital printing machine

Article 3 the General Administration of publishing is responsible for the supervision and administration of digital printing throughout the country, and the local publishing administrative departments at or above the county level are responsible for the supervision and administration of digital printing within their respective administrative regions

local publishing administrative departments at or above the county level should strengthen the guidance, supervision and management of enterprises engaged in digital printing business activities (hereinafter referred to as digital printing business enterprises) in their administrative areas, and strengthen the training of digital printing operators in relevant laws and regulations

Article 4 the State supports and encourages digital printing enterprises to adopt new technologies, explore new models and provide new services

digital printing enterprises should establish a quality assurance system, and the quality of printing products should meet national and industrial standards

Chapter II Establishment of enterprises Article 5 the State implements a licensing system for digital printing business activities; Without permission, no unit or individual may engage in digital printing business activities

Article 6 to establish a digital printing enterprise, the following conditions shall be met:

(1) having the name and articles of association of the enterprise

(2) there is a definite business scope

(III) have fixed production and business premises that meet the needs of the business scope, with a construction area of not less than 50 square meters

(IV) have the capital to maintain normal production and operation, and the registered capital is not less than 1million yuan

(V) have more than one production-oriented digital printing machine

(VI) having organizations and personnel that meet the needs of business scope

(VII) other conditions stipulated by relevant laws and administrative regulations

In addition to the provisions of the preceding paragraph, the examination and approval of the establishment of digital printing enterprises shall also comply with the national plan on the total amount, structure and layout of printing enterprises

Article 7 to establish a digital printing enterprise, an application shall be submitted to the local provincial publishing administration department, and the following application documents shall be submitted:

(I) application form. Specify the name and address of the applicant, the name and address of the legal representative or main person in charge, the source and amount of funds, the composition of capital and the main matters of the application

(II) enterprise name pre-approval notice and articles of association

(III) capital credit certificate issued by legal capital verification institution

(IV) feasibility study report

(V) proof of business premises and necessary production conditions

(VI) identity certificate and resume certificate of the legal representative or main person in charge

Article 8 the provincial publication administration department shall make a decision of approval or disapproval within 20 days from the date of accepting the application, and notify the applicant. If the application for establishment is approved, the provincial publishing administration department shall issue a printing business license, and the column of business scope shall indicate that it is engaged in the printing of publications, packaging and decoration prints and other prints in the form of digital printing; If the application is not approved, the reasons shall be given

the provincial publishing administrative department shall, within 20 days from the date of issuing the printing business license, submit the approval documents and copies of the printing business license (original and duplicate) to the General Administration of publication for the record

Article 9 digital printing business activities can take the form of chain operation

digital printing chain operation enterprises carry out digital printing operation activities under the unified management of chain operation headquarters (hereinafter referred to as chain headquarters) and implement standardized management

in addition to the provisions of Article 6 of these measures, digital printing chain operation enterprises shall also meet the management requirements of chain operation modes such as direct chain operation and franchise chain operation. Enterprises engaged in digital printing chain operation that can save 50% - 80% energy on the existing basis should be composed of more than five chain stores, and the registered capital of the chain headquarters should not be less than 5million yuan

Article 10 to establish a digital printing chain business enterprise, the chain headquarters shall submit the application materials, the list of business sites and operation plans of the chain headquarters and chain stores specified in Article 7 of these measures to the local provincial publishing administration department. After the chain headquarters is licensed, each chain store shall take the "printing business license" (copy) of the chain headquarters and the application materials of the headquarters to the local provincial publishing administration department for filing, and receive the "printing business license" (original and copy). The column of business scope indicates that it is engaged in the printing of publications, packaging and decoration prints and other prints by means of digital printing chain operation

Article 11 for the establishment of foreign-invested digital printing enterprises, in addition to complying with the provisions of these measures, the proportion of Chinese and foreign investment and rights and interests shall also comply with the relevant provisions of the Interim Provisions on the establishment of foreign-invested printing enterprises and the supplementary provisions. 1 Liquid medium must be added into the low-temperature tank before use

Article 12 existing enterprises engaged in the printing business activities of publications, packaging and decoration printed materials or other printed materials that carry out digital printing business activities within the originally approved business scope are exempted from the approval procedures for digital printing

if the existing enterprises engaged in the printing business activities of publications, packaging and decoration printed matter or other printed matter carry out digital printing business activities beyond the originally approved business scope, they shall go through the approval procedures for digital printing at the local provincial publishing administrative department in accordance with the provisions of articles 6 to 8 of these measures

Chapter III Management of business activities Article 13 digital printing enterprises must strictly abide by relevant national laws and regulations and accept the daily supervision and management of the local publishing administration department

the legal representative or the main person in charge of a digital printing business enterprise shall receive regular business training organized by the publishing administration department and obtain the "printing regulations training certificate" issued by the provincial publishing administration department

Article 14 a digital printing business enterprise shall establish and improve systems for printing entrustment, printing verification, printing registration, printing keeping, printing delivery, and destruction of defective products in printing activities

Article 15 a digital printing business enterprise shall hang a printing business license in a conspicuous position on its business premises

those who engage in printing business activities through the Internet should publicize the "printing business license" in a prominent position on the front page of the station

Article 16 Where a digital printing business enterprise accepts a commission to print publications, it shall verify the printing power of attorney and other legal documents in accordance with the relevant provisions of the regulations on the administration of the printing industry

Article 17 If a digital printing business enterprise accepts the entrustment to print packaging and decoration printed materials and other printed materials, it shall go through the relevant procedures in accordance with the regulations on the administration of printing industry

Article 18 If a digital printing chain business enterprise has established a standardized and unified business management system and accepts the entrusted printing of publications under the unified organization of the chain headquarters, the entrusted chain headquarters or chain stores shall verify and retain the relevant printing authorization and the samples of the entrusted printing publications for future reference, and other chain stores shall be exempted from relevant procedures

Chapter IV law

Article 19 those who engage in digital printing business activities without approval shall be banned by the public security department and the administrative department for Industry and Commerce in accordance with their statutory functions and powers

Article 20 If a digital printing business enterprise violates the relevant provisions, it shall be given administrative punishment according to the regulations on the administration of printing industry; If the circumstances are serious, the original license issuing authority shall revoke the license; If a crime is constituted, the offender shall be investigated for criminal responsibility according to law

Article 21 the chain headquarters of a digital printing chain enterprise shall strengthen the management of the daily business activities of the chain stores

if a chain store is subject to an administrative penalty of more than a fine (including a fine) imposed by the publishing administration department, the unit implementing the administrative penalty shall file the penalty result with the provincial publishing administration department where the chain headquarters is located. If a chain store is subject to administrative penalties of more than two fines (including fines) in a year, the chain headquarters shall cancel the chain store or terminate the chain business relationship with the chain store, and the original license issuing authority shall revoke the printing business license of the chain store in accordance with the relevant provisions of the regulations on the administration of printing industry with serious violations

if more than one-third of the chain stores are subject to administrative penalties above fines (including fines) within one year, the provincial publishing administration department shall order the chain headquarters to rectify; If the rectification is not passed, in order to adapt to the application for foam granulator in the new era, the original license issuing authority will revoke the printing business license of the chain headquarters and all chain stores in accordance with the relevant provisions of the regulations on the administration of printing industry revealed by the evaluation results of trial products

Article 22 enterprises that have engaged in digital printing business activities before the implementation of these Measures shall go to the provincial publishing administration department to go through relevant procedures in accordance with these measures within 180 days from the date of implementation of these measures

Article 23 these Measures shall enter into force as of February 1st, 2011
